They’re designed to protect both you and us by setting clear expectations around how our services work, what we promise, and what we require in return. By using our website, purchasing, or participating in any Ace the Essay service, you agree to these terms.

1. Who We Are

Ace the Essay is owned and operated by MESCONTE ENTERPRISES, LLC (“Company,” “we,” “us,” or “our”).
The term “you” refers to any purchaser or participant using our services (“Services”) and their related materials (“Program Materials”).

2. Use and Consent

By purchasing or using our Services, you agree to follow these Terms & Conditions, our Privacy Policy, and any other written policies or agreements that apply. Accessing or using our Services in any way constitutes your consent to be bound by these terms.
If you are under 16 years old, you may use our Services only with permission from a parent or guardian.

3. Mutual Respect Policy

We believe great writing begins with respect—for yourself and for others.
Ace the Essay does not tolerate hate speech, discrimination, harassment, or abusive behavior in any form.
This includes language or actions that demean or target anyone based on race, ethnicity, religion, gender, sexual orientation, or any personal characteristic. If such conduct occurs, we reserve the right to end our working relationship or revoke access to Services immediately and without refund. Everyone deserves to feel safe and valued here.

4. Intellectual Property Rights

All content within our Services and Program Materials is owned by or licensed to us and protected by copyright, trademark, and other intellectual-property laws. You are granted a limited, non-transferable license for personal, non-commercial use only.
You may download or print materials for your own educational use, but you may not share, sell, copy, modify, or distribute them for any commercial purpose without our written consent. All rights not expressly granted are reserved. If you wish to request permission to use any portion of our content, please email valerie@acetheessay.com before doing so.

5. Personal Responsibility and Assumption of Risk

Our Services are designed for educational and informational purposes only. You agree to use your own judgment and assume all risks. Results vary by individual, and we do not guarantee admission outcomes, acceptance decisions, or specific academic results. You are solely responsible for your actions, choices, and results.

Educational Disclaimer

Ace the Essay and MESCONTE ENTERPRISES, LLC are not accredited, licensed, or evaluated by any governmental or academic body. Completion of our courses or coaching does not grant certification, licensure, or academic credit.

Admissions Disclaimer

We cannot and do not guarantee acceptance, rejection, or other outcomes at any educational institution. Our work helps students express themselves authentically—it does not influence institutional decisions.

Medical, Legal, and Financial Disclaimer

Our Services are not substitutes for professional medical, legal, or financial advice. Always consult qualified professionals regarding your specific situation. You are solely responsible for your own results and decisions.

Warranties Disclaimer

Services and materials are provided “as is” without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access, error-free operation, or freedom from harmful components.

7. Purchases and Payments

By submitting payment information, you authorize Ace the Essay to charge your card for all agreed amounts. You agree to be financially responsible for all purchases made by you or anyone acting on your behalf. Our Services may not be purchased for speculative, false, or fraudulent purposes.

8. Refund and Reschedule Policy

All sales are final. We’re proud to stand behind our work and the results our students achieve. However, if unforeseen circumstances arise, Ace the Essay may, at its sole discretion, offer a reschedule, partial credit, or alternative accommodation. Clients may reschedule one meeting per package with at least 72 hours’ notice via email to info@acetheessay.com. If you do not attend a scheduled meeting without such notice, the session and its cost are forfeited.

9. Chargebacks

Chargebacks are not permitted. Any attempt to dispute a legitimate charge will constitute a breach of these Terms and may result in immediate termination of access to Services. We encourage clients to contact us first to resolve any billing concerns.

10. Confidentiality and Privacy

When you use our Services, we may collect personal information such as your name, email address, phone number, and payment details. By providing such information, you grant us permission to use and store it as needed to deliver our Services and communications. We use our best efforts to keep your information safe and confidential in accordance with our Privacy Policy.

What We Do with Personal Information

We may use your data for:

• Internal record-keeping
• Improving our Services
• Sending occasional updates or      promotions (you may unsubscribe anytime)
• Research and aggregate reporting      (non-identifiable)
• Personalizing your experience
• Providing support and      communication related to your Services

Storage

All personal data is stored may be stored on GoDaddy.com, Calendly.com, Zoom.com, Stripe.com, Google.com, Microsoft.com. You will never be asked for your Social Security Number, birthdates, or for personal passwords. If any of this information is provided it will be done so at your own will. Only data stored in the areas outlined may be accessed by authorized personnel who manage communications or service delivery. By using our Services, you acknowledge that our team, staff, or affiliates who manage such systems may have access to your information.

Viewing by Others

Any personal information shared by you in group settings (e.g., workshops, social-media communities) may be seen or used by others. We cannot control or be responsible for unauthorized use by third parties of information you voluntarily share publicly.

Passwords

You are responsible for maintaining the confidentiality of any account login or password issued to you. If we learn that a password has been shared, we may terminate access immediately. We will not be liable for loss or damage resulting from your failure to protect your password or account information.

11. Respectful Use of Services

You agree to use our Services only for lawful purposes. You will not post or transmit anything that is illegal, threatening, defamatory, abusive, obscene, or otherwise objectionable. You agree not to upload malware, spam, or engage in any conduct that disrupts our Services or community spaces. We reserve the right to remove participants or content that violate this policy.

12. Limitation of Liability and Indemnification

To the fullest extent permitted by law, Ace the Essay and MESCONTE ENTERPRISES, LLC will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services or materials. You agree to indemnify and hold us harmless from any claims, losses, or expenses (including attorney’s fees) arising from your use or misuse of our Services or your violation of these Terms.

13. Dispute Resolution

We always hope to resolve any differences amicably by email at info@acetheessay.com. If resolution cannot be reached, any dispute shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association, held in Pittsfield, Massachusetts before a single mutually selected arbitrator. The arbitrator may award any remedy available under applicable law, limited to actual damages and excluding consequential or punitive damages. Either party may enter the arbitrator’s decision as a judgment in any court of competent jurisdiction.
The prevailing party shall be entitled to reasonable attorney’s fees and costs. Any arbitration must begin within one (1) year of the event giving rise to the dispute. You agree not to engage in public or social-media communications designed to disparage Ace the Essay or its representatives. Nothing in this clause prevents you from participating in lawful proceedings when required.

14. Technology and Access

We strive to provide reliable, uninterrupted access to our website and materials, but we cannot guarantee perfect performance. Temporary interruptions for maintenance, updates, or technical issues may occur. We are not responsible for losses resulting from such interruptions.

15. Changes to Terms

We may update these Terms & Conditions at any time. The most recent version will always appear on this page. By continuing to use our Services after changes are posted, you agree to the revised Terms.
